सफल आवेदक के चयन प्रक्रिया में पारदर्शिता सुनिश्चित करने के लिए काष्ठ आधारित उद्योग (का0आ0उ0) इकाई स्थापित करने के लिए नए लाइसेंस के लिए आवेदन करने के लिए संशोधित नियम और शर्तें

1) आवेदन केवल ‘ऑनलाइन मोड‘ में वन एवं वन्यजीव विभाग, उत्तर प्रदेश काष्ठ आधारित उद्योग की वेबसाइट www.upforest.gov.in (काष्ठ आधारित उद्योग एम0आई0एस0 के अन्तर्गत का0आ0उ0 इकाई के नवीन लाइसेंस के लिए संबंधित पोर्टल) में भरे जायेंगे। आवेदक संबंधित जनपद के प्रभागीय वनाधिकारी/प्रभागीय निदेशक के कार्यालय से संपर्क कर ऑनलाइन आवेदन जमा करने में उनकी सहायता प्राप्त कर सकते हैं। प्रभागीय वनाधिकारी/प्रभागीय निदेशक के दूरभाष नंबर वन एवं वन्यजीव विभाग, उत्तर प्रदेश की वेबसाइट पर उपलब्ध है। आवेदक सदस्य सचिव, राज्य स्तरीय समिति, का0आ0उ0 उत्तर प्रदेश के कार्यालय से उनके फोन नंबर 0522-2206184 पर भी संपर्क कर सकते है।

2) अर्हता मानदंडः -
(अ) आवेदक की आयु आवेदन जमा करने के अंतिम दिनांक को 18 वर्ष की होनी चाहिये।
(ब) का0आ0उ0 इकाईयों की सभी श्रेणियों में प्रस्तावित निवेश रू0 100 करोड़ तक होने की स्थिति में सकल सम्पत्ति (नेट वर्थ) प्रस्तावित निवेश के एक चैथाई एवं प्रस्तावित निवेश रुपये 100 करोड़ से अधिक होने की स्थिति में सकल सम्पत्ति (नेट वर्थ), प्रस्तावित निवेश का एक तिहाई से न्यून नहीं होना चाहिये। आवेदकों को अपनी सकल सम्पत्ति (नेट वर्थ) के प्रमाण के रूप में सम्बन्धित अभिलेख जमा करने होंगे। इन अभिलेखों में 3 वर्ष की लेखा परीक्षित बैलेंस शीट, 3 वर्षों का आयकर रिटर्न, बैंक से प्राप्त सॉल्वैसी प्रमाण पत्र या कोई अन्य प्रासंगिक अभिलेख शामिल हैं।

3) प्रकाष्ठ आधारित उद्योग आठ श्रेणियों में वर्गीकृत हैं जिनके अन्तर्गत आवेदक नए लाइसेंस के लिए आवेदन कर सकता है। ये श्रेणियां हैं 1) आरा मिल, 2) विनियर मिल, 3) प्लाईवुड इकाई, 4) विनियर एवं प्लाईवुड इकाई, 5) स्टैण्ड एलोन चिपर, 6) एम0डी0एफ0, एच0डी0एफ0, 7) पार्टिकल बोर्ड इकाई, 8) एम0डी0एफ0/ एच0डी0एफ0 + पार्टिकल बोर्ड इकाई

4) चूंकि प्र0आ0उ0 की प्रत्येक श्रेणी में मशीनरी सीधे प्रकाष्ठ की खपत से जुड़ी हुई है, अतः राज्य स्तरीय समिति (एस0एल0सी0) द्वारा प्रत्येक श्रेणी के अन्तर्गत विभिन्न मशीनरी की संख्या को आवश्यकतानुसार निर्धारित करने का निर्णय लिया गया है। प्रत्येक श्रेणी के अन्तर्गत विभिन्न मशीनरी की न्यूनतम और अधिकतम संख्या जिसके लिए आवेदक आवेदन कर सकता है, निम्नानुसार होना चाहियेः –

5) आवेदक, एक कानूनी इकाई के रूप में, प्रत्येक श्रेणी में लाइसेंस के लिए आवेदन कर सकता हैं। कानूनी इकाई में व्यक्तिगत, एकल साझेदारी वाली फर्म, साझेदारी फर्म, व्यक्तियों का संघ (ए0ओ0पी0), हिंदू अविभाजित परिवार (एचयूएफ), प्राइवेट लिमिटेड कंपनी, पब्लिक लिमिटेड कंपनी, सरकारी विभाग या उपक्रम और सीमित देयता भागीदारी (एल0एल0पी0) शामिल है। प्रत्येक श्रेणी के लिए अलग आवेदन की आवश्यकता होगी। आवेदक के एक से अधिक श्रेणियों के लिए सफल होने की स्थिति में वह अपनी पसंद की श्रेणी में केवल एक लाइसेंस प्राप्त करने के लिए अर्ह होगा।

6) प्रत्येक श्रेणी के अन्तर्गत प्राप्त आवेदन इस उद्देश्य के लिए मात्राकृत की गई उपलब्ध प्रकाष्ठ से अधिक होने की स्थिति में का0आ0उ0 की ऐसी श्रेणी के लिए पारदर्शी तरीके से लॉट का ऑनलाइन ड्रा आयोजित किया जाएगा। किसी भी मामले में आवेदक के ड्रा के माध्यम से एक से अधिक श्रेणियों में लाइसेंस प्राप्त करने में सफल हो जाने की स्थिति में उसे अपनी पसंद की श्रेणी में केवल एक लाइसेंस प्राप्त होगा।

7) पोर्टल में प्राविधानित भुगतान गेटवे के माध्यम से आवेदक द्वारा आवेदन जमा करने के समय प्रतिभूति धनराशि (अर्नेस्ट मनी) के रूप में का0आ0उ0 इकाई की प्रत्येक श्रेणी के लिये निर्धारित वार्षिक शुल्क के समतुल्य धनराशि जमा करनी होगी। सफल आवेदकों से आवेदन पत्र प्रस्तुत करते समय जमा कराई गई प्रतिभूति धनराशि लेटर ऑफ ऑफर /सैद्धान्तिक स्वीकृति निर्गत करते समय आगामी 5 वर्षों हेतु जमा की जाने वाली वार्षिक शुल्क की धनराशि में समायोजित की जायेगी। का0आ0उ0 की समस्त श्रेणियों के लिए वार्षिक शुल्क राशि निम्नानुसार हैः-

8) सफल आवेदक को लाइसेंस दो चरणों की प्रक्रिया के माध्यम से दिया जाएगा। आवेदकों से प्राप्त आवेदनों के ऑनलाइन ड्रा के माध्यम से लाइसेंस प्राप्त करने में सफल होने पर आवेदक को सैद्धान्तिक अनुमोदन/प्रस्ताव पत्र निर्गत किया जाएगा। इस पत्र में विभिन्न नियम और शर्तें निर्धारित होगी। इन शर्तो में भूमि, उपकरण एवं संयंत्र की खरीद व्यवस्था एवं का0आ0उ0 स्थापित करने हेतु एस0एल0सी0 द्वारा निर्दिष्ट समयरेखा आदि शामिल होंगे।<

9) प्रत्येक सफल आवेदक को सैद्धान्तिक स्वीकृति/प्रस्ताव पत्र प्राप्त होने के उपरान्त एक मास के अन्दर का0आ0उ0 की सुसंगत श्रेणी हेतु निर्धारित 04 वर्ष का अवशेष वार्षिक शुल्क स्वीकार पत्र के साथ ऑनलाईन जमा करनी होगी। स्वीकार पत्र के लिए निर्धारित प्रारूप, प्रस्ताव पत्र के साथ प्रदान किया जाएगा।

उपरोक्त पैरा 7 की तालिका में उल्लिखित का0आ0उ0 इकाइयों के लिए निर्धारित प्रथम 5 वर्षों के शुल्क का भुगतान नए लाइसेंस निर्गत करने से पूर्व करना होगा। यह लाइसेंस निर्गत होने के वर्ष से पांचवें वर्ष के 31 दिसंबर तक मान्य होगा। इसके उपरान्त उपरोक्त बिन्दु संख्या 7 के अनुसार ‘‘वार्षिक नवीनीकरण शुल्क‘‘ के भुगतान के बाद लाइसेंस 1 से 5 साल के लिए नवीनीकरण किया जाएगा।

10) का0आ0उ0 इकाई के आवेदक द्वारा संयंत्र और मशीनरी की लागत असत्य/कम दर्शाये जाने पर ऐसे प्रकरणों को गंभीरता से लेते हुये सैद्धांतिक स्वीकृति/प्रस्ताव पत्र या वास्तविक लाइसेंस निरस्त किया जा सकता है।

11) ऑनलाइन आवेदन दाखिल करने के समय सकल सम्पत्ति (नेट वर्थ) समर्थन में प्रासंगिक दस्तावेज जमा करने में विफल रहने वालों के ऑनलाइन आवेदनों पर विचार नहीं किया जाएगा। सकल सम्पत्ति (नेट वर्थ) मानदंड आवश्यकता पूर्ण न करने वाले आवेदकों के आवेदन आगामी जाँच के लिये स्वचालित रूप से अयोग्य घोषित हो जाएंगे और उनके आवेदन अनर्ह के रूप में निरस्त हो जायेंगे। केवल अर्ह आवेदकों में से ही ऑनलाईन Draw of lots के माध्यम से सफल आवेदक का चयन किया जायेगा।

12) सैद्धांतिक स्वीकृति/प्रस्ताव पत्र प्राप्त करने वाला आवेदक यदि प्रस्ताव स्वीकार नहीं करना चाहता है, तो उस श्रेणी के लिए जमा प्रतिभूमि धनराशि जिसमें आवेदक को लाइसेंस की पेशकश की जा रही है उसे जब्त कर लिया जाएगा और कोई भी धनराशि वापस नहीं लौटाई जाएगी। ऐसा आवेदक जिसे प्रस्ताव पत्र जारी किया गया है, किन्तु निर्धारित एक महीने की अवधि में उसका स्वीकार पत्र प्राप्त न होने की स्थिति में इसे आवेदक द्वारा प्रस्ताव की अस्वीकार्यता के रूप में माना जाएगा जिसके लिए केवल सम्बन्धित आवेदक ही उत्तरदायी होगा।

13) सैद्धांतिक स्वीकृति/प्रस्ताव पत्र प्राप्त करने के उपरान्त यदि आवेदक निर्धारित अवधि तक उल्लिखित नियमों और शर्तों का पालन नहीं करता है तब उस स्थिति में ऐसा माना जायेगा कि सैद्धांन्तिक स्वीकृति/प्रस्ताव पत्र निरस्त हो गया है और उस श्रेणी के लिए जिसके लिये आवेदक को लाइसेंस दिया जाना प्रस्तावित किया गया था, की प्रतिभूमि धनराशि एवं शेष 4 वर्ष का जमा किया गया वार्षिक शुल्क जब्त कर लिया जाएगा।

14) ऑनलाइन ड्रॉ के माध्यम से एक से अधिक श्रेणियों में आवेदक के सफल होने की स्थिति में उसे अपनी पसंद की श्रेणी में केवल एक लाइसेंस बनाए रखने की अनुमति दी जाएगी। ऐसे प्रकरणों में लाइसेंस बनाये रखने की श्रेणी के अतिरिक्त श्रेणियों में जमा प्रतिभूति धनराशि बिना ब्याज के वापस कर दी जाएगी। असफल आवेदकों को प्रतिभूति धनराशि बिना ब्याज के वापस कर दी जाएगी।

15) सफल आवेदक जिसे सैद्धांतिक स्वीकृति/प्रस्ताव पत्र दिया गया है या का0आ0उ0 इकाई स्थापित करने के लिए लाइसेंस जारी किया गया है, वह सैद्धांतिक स्वीकृति/ प्रस्ताव पत्र या ‘निर्गत किया गया वास्तविक लाइसेंस‘ स्थानांतरित करने के लिये का0आ0उ0 इकाई स्थापित करने के पूर्व अर्ह नहीं होगा।

16) प्रत्येक आवेदक को आवेदन पत्र में वचनबद्धता देनी होगी कि वह का0आ0उ0 इकाई की स्थापना और संचालन के लिए प्रासंगिक सभी कानूनों/नियमों/निर्णयों एवं एस0एल0सी0 का0आ0उ0 उत्तर प्रदेश, अन्य राजकीय संस्थानों, न्यायालय जिसमें सुसंगत मार्ग निर्देशों/नियमावलियों/भारतीय वन अधिनियम आदि के अनुसार एस0एल0सी0 द्वारा प्राधिकृत अधिकारी भी शामिल है, जारी सभी निर्देशों का पालन करेगा।

17) भारत सरकार द्वारा निर्गत प्रकाष्ठ आधारित उद्योगों की स्थापना एवं विनियमन मार्ग निर्देश 2016 (यथा संशोधित) एवं उ0प्र0 प्रकाष्ठ आधारित उद्योग स्थापना एवं विनियमन (षष्ठम संशोधन) नियमावली 2018 के प्राविधानों के अन्तर्गत का0आ0उ0 इकाइयों के पंजीकरण मा0 उच्च न्यायालय में दायर पी0आई0एल0 सिविल संख्या 1866/2018 (एसोसियेशन फार कामन प्यूपिल बनाम भारत संघ) के अन्तिम निर्णय के अधीन होंगे।

18) काष्ठ आधारित उद्योगों को निकटतम अधिसूचित वनों या संरक्षित क्षेत्रों जिसमें सड़क किनारे/रेलवे लाइन किनारे/नहर किनारे वृक्षारोपण शामिल नहीं है, के 10 किमी0 की हवाई दूरी से बाहर काष्ठ आधारित उद्योगों के संचालन की ही अनुमति दी जायेगी। हालांकि, औद्योगिक क्षेत्र या नगर पालिका क्षेत्र में काष्ठ आधारित उद्योग स्थापित किये जा सकते है, ऐसी इकाइयां निकटतम अधिसूचित वन या संरक्षित क्षेत्रों की निकटवर्ती सीमा की हवाई दूरी से मुक्त होगी। संरक्षित क्षेत्रों के ईको सेंसिटिव जोन के प्राविधान जैसा कि अधिसूचना मे उल्लिखित हो काष्ठ आधारित उद्योगों की स्थापना के समय सज्ञान में लिये जायेंगे।

Revised Terms and Conditions for applying for new license to set up Wood Based Industries (WBI) unit for ensuring transparency in the process of selection of successful applicant

1) Application is to be submitted in ‘online mode’ only on the website of the Department of Forests and Wildlife, Uttar Pradesh i.e. www.upforest.gov.in (the concerned portal for New Licenses of WBI Unit under Wood Based Industries MIS). Applicant can approach the office of Divisional Forest Officer/Divisional Director in the concerned district and take the help of authorities in submitting the online applications. The telephone numbers of the Divisional Forest Officers/Divisional Directors are available on the website of Department of Forests and Wildlife, Uttar Pradesh. The applicant can also approach the office of the Member Secretary, State Level Committee, WBI Uttar Pradesh on their phone number 0522-2206184.

2) Eligibility Criteria:-
(A) Applicant should have completed 18 years of age as on the last date of submission of application.
(B) All categories of WBI units with proposed investment of upto Rs. 100 crores should have net worth of not less than one fourth of the proposed investment and those with proposed investment of more than Rs. 100 crores should have net worth of not less than one third of the proposed investment. Applicants will be required to submit relevant documents in support of their net worth i.e. 3 years audited balance sheet, 3 years income tax returns, solvency certificate from the bank or any other relevant documents.
3) There are eight categories of wood based industries under which applicant can apply for new license. These categories are 1) Saw Mill, 2) Veneer Mill, 3) Plywood Unit, 4) Veneer & Plywood Unit, 5) Stand alone Chipper, 6) MDF/HDF, 7) Particle Board Unit, 8) MDF/HDF + Particle Board Unit.
4) Since machinery in each category of WBI is directly linked with the consumption of wood, the State Level Committee (SLC) has decided to rationalize the number of various machinery under each category. Minimum and maximum number of various machinery under each category for which applicant can apply would be as follows:-

5) Applicant, as one legal entity, can apply for license in each category. The legal entity includes Individual, Sole Proprietorship Firm, Partnership Firm, Association of Persons (AOP), Hindu Undivided Family (HUF), Pvt. Ltd. Company, Public Limited Company, Government Department or undertaking and Limited Liability Partnership (LLP). Separate application will be needed for each category. In case the applicant becomes successful for more than one category, in that case he/she will be eligible to get only one license in the category of his/her choice

6) If the applications received under each category are more than the quantified available wood for this purpose then online draw of lots will be conducted in a transparent manner for such category of WBI. In any case if the applicant becomes successful to get license in more than one category through draw of lots, he or she would get only one license in the category of his choice.

7) Applicant has to deposit amount equivalent to annual fee proposed to be charged for each category of WBI in the form of ‘Earnest Money’ at the time of submission of application through a payment gateway provided in the portal. The earnest money so deposited shall be adjusted towards 5 years annual fee to be paid by the successful applicants at the time of issuance of in-principle approval/a ‘Letter of Offer’. The Annual fee amount for all the categories of WBIs is as under:-

8) The award of license to a successful applicant will be done through a two stage process. On being successful to receive a license through online draw of lots the applicant will be issued an in- principle approval/a ‘Letter of Offer’ online stipulating various terms and conditions including purchase/arrangement of land, plant and machinery, commissioning of WBI unit etc as per the timeline specified by the SLC.

9) Each successful applicant on receipt of in-principle approval/a letter of offer will be required to deposit the balance 4 years annual fee applicable to the relevant category of WBI after along with a ‘Letter of Acceptance' to be submitted online within a period of one month from the date of issue of in-principle approval/a 'Letter of Offer’. The prescribed format for Letter of Acceptance will be provided along with the Letter of Offer.

Before issuance of the new license to WBI units fee for first 5 years as prescribed in the table in para-7 above will be required to be paid. This license will be valid upto 31 December of the fifth year from the year of issuance. Thereafter, the license will be renewed for 1 to 5 years after payment of following “annual renewal Fee”.

10) Cases of false/under reporting of the cost of Plant and Machinery by the applicant of WBI unit will be viewed seriously, leading to cancellation of in-principle approval/a letter of offer or actual license.

11) The Applicants who fail to submit relevant documents in support of their net worth at the time of filing of online application, their online applications will not be considered. Those applicants who do not qualify the net worth criteria/requirement shall stand automatically disqualified for further scrutiny and their applications will be rejected as ineligible. The Online draw of lots will be conducted only in respect of eligible applicants.

12) If upon receiving in-principle approval/a letter of offer the applicant does not want to accept the offer, then the earnest money deposited for the category in which the applicant is being offered a license will be forfeited and no refund will be made. If the acceptance letter from the applicant whom Letter of Offer has been issued is not received within the prescribed one month then it will be construed as rejection of offer by the applicant for which he will only be responsible.

13) If after receiving in-principle approval /a letter of offer the applicant does not comply with the terms and conditions spelt out there-in within the specified time period, in-principle approval /a letter of offer will be deemed to have been cancelled and the earnest money as also the balance 4 years annual fee deposited for the category in which the applicant is being offered a license will be forfeited.

14) In case of an applicant being successful in more than one category through online draw of lots, he or she shall be allowed to retain only one license in the category of his choice. In such cases earnest money deposited in categories other than the retained one will be refunded without interest. The earnest money of non-successful applicants will be refunded without interest.

15) A successful applicant who is either given in-principle approval/a letter of offer or issued a license to establish a WBI unit shall not be eligible to transfer in-principle approval/a letter of offer or the ‘actual license issued’, before commissioning of the WBI unit.

16) Each applicant has to give an undertaking in the application form that he or she will comply with all the laws/rules/decisions relevant to the establishment and operation of WBI unit and all the directions issued by SLC, WBI Uttar Pradesh, other government authorities and the court including the officer authorized by the SLC as per relevant Guidelines/Rules/Indian Forest Act etc.

17) The registration of WBI units under the provisions of Wood Based Industries Establishment and Regulation Guidelines, 2016 (As Amended) issued by Government of India and Uttar Pradesh Wood Based Industries Establishment and Regulation (Sixth Amendment) Rules, 2018 will be under taken in accordance with the final judgment and orders of the Hon'ble High Court in the P.I.L. Civil No. 1866 of 2018 (Association For Common People vs. Union of India).

18) Wood Based Industries shall be allowed to operate beyond ten kilometers of aerial distance from the boundary of nearest notified forests or protected areas, excluding roadside/railway side/canal side plantations. However, a Wood Based Industries can be established in a Industrial Estate or a Municipal Area, irrespective of the aerial distance from the boundary of nearest notified forest or protected area. The provisions of Eco Sensitive Zones of protected areas (PAs) as contained in the notification will be taken into consideration for establishment of Wood Based Industries.
